Terms of Service
These Terms of Service ("Terms") set out the conditions for using "X Lists" (the "Service") provided by DigVal.inc ("we" or "us"). These Terms are a translation of the Japanese original; if there is any discrepancy, the Japanese version prevails.
1. Scope
These Terms apply to every relationship between us and users concerning the Service.
2. Definitions
- "User" means an individual or company that has agreed to these Terms and registered for the Service.
- "Credit" means the unit of extraction in the Service. Extracting one account uses one credit.
- "Extracted Data" means data, including CSV files, that a user obtains through the Service.
3. Registration
- Registration is complete when an applicant agrees to these Terms and signs up using the method we provide (a Google account or an email address).
- We may refuse or cancel a registration that uses false information, comes from someone who has previously violated these Terms, or that we otherwise consider inappropriate.
4. Account management
Users are responsible for managing their account and password and must not let third parties use them. Except in cases of our intent or gross negligence, we are not liable for damage caused by unauthorized use of an account.
5. The Service
- The Service extracts information about accounts related to public X (formerly Twitter) accounts or public posts specified by the user (followers, following, repliers, keyword posters, etc.) and provides it in CSV format.
- Results depend on X's specifications and visibility settings, so we do not guarantee that the requested number of accounts will be extracted, that any particular field will be obtained, or how long extraction will take.
6. Fees and payment
- Fees for paid plans are as shown on the Service's pricing page. US dollar prices are charged as shown. Japanese yen prices exclude tax, and 10% Japanese consumption tax is added at checkout.
- Payment is by credit card through Stripe.
- Paid plans renew automatically every month. The first payment is charged when you subscribe, and subsequent payments are charged automatically on each monthly renewal date.
7. Credits
- Free credits are granted at sign-up. Paid plans grant credits according to the plan with each payment.
- Credits for the requested number of accounts are used when an extraction is requested. Unused credits roll over to following months.
- If an extraction returns fewer accounts than requested, the credits for the difference are returned automatically. If an extraction fails, all credits used for it are returned.
- Credits cannot be exchanged for cash, refunded or transferred to third parties. Unused credits expire when you close or delete your account.
8. Cancellation and refunds
- You can cancel a paid plan at any time from the settings page. After cancelling, you can use the Service until the end of the current period, and billing stops from the next renewal date.
- Due to the nature of digital services, payments are non-refundable once completed, except where required by law.
9. Prohibited conduct
When using the Service, users must not:
- Violate laws or public order and morals
- Use Extracted Data for spam, nuisance, harassment, stalking, discrimination or defamation
- Handle personal information in Extracted Data in violation of applicable data protection laws
- Violate X's terms of service or those of any other platform
- Sell or redistribute Extracted Data, in whole or in part, as data to third parties
- Infringe the rights of third parties, including intellectual property, publicity and privacy rights
- Interfere with the operation of the Service, gain unauthorized access, place excessive load on it, or reverse engineer it
- Impersonate others or register false information
- Engage in any other conduct we consider inappropriate
10. Extracted Data
Users use Extracted Data at their own responsibility and must comply with applicable laws and X's terms of service. If a dispute with a third party arises from the use of Extracted Data, the user will resolve it at their own responsibility and expense.
11. Suspension
If a user violates these Terms, we may suspend their use of the Service, delete their registration or take other necessary measures without prior notice. In that case, fees already paid and credits already granted will not be refunded.
12. Changes, interruption and termination of the Service
We may change the Service or interrupt or end it without prior notice due to changes in X's specifications, system maintenance, force majeure or other reasons. Except in cases of our intent or gross negligence, we are not liable for any resulting damage to users.
13. Disclaimer
- We do not warrant that the Service is free from factual or legal defects, including accuracy, completeness or fitness for a particular purpose.
- Even where a user suffers damage for which we are responsible, our liability, except in cases of intent or gross negligence, is limited to the fees the user paid us in the month the damage occurred.
14. Changes to these Terms
We may change these Terms when we consider it necessary. Revised Terms take effect when posted on the Service.
15. Governing law and jurisdiction
These Terms are governed by the laws of Japan. Any dispute concerning the Service is subject to the exclusive jurisdiction, in the first instance, of the district court with jurisdiction over the location of our general operations manager.
